1. About us

These Terms govern your use of the Equine Evaluate website and services (the "Service"), operated by Virtuate LTD ("we", "us", "our"). By using the Service you agree to be bound by these Terms.

2. The Service

Equine Evaluate provides independent equine valuation reports, advert reviews and similar-horse comparison information generated by our system. Reports are guidance only and are not a substitute for an in-person veterinary or professional inspection.

3. Acceptable use

You agree not to:

  • Use the Service unlawfully, fraudulently, or for spam;
  • Infringe any intellectual property, privacy or other rights;
  • Interfere with the security or integrity of the Service (including scraping, malware, probing or reverse engineering);
  • Resell, redistribute or commercially exploit reports without our written consent.

4. Accounts and accuracy

You must provide accurate information and keep account credentials confidential. You are responsible for all activity that occurs under your account or contact email.

5. Intellectual property

All software, branding, report formats and content (other than information you submit) are owned by us or our licensors. We grant you a limited, non-exclusive, non-transferable right to use the Service and any report you have paid for, for your own personal or internal business use.

6. Payments, billing and refunds

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, tax, cancellation and refund mechanics are governed by the Paddle Buyer Terms. Our own refund policy is set out in our Refund Policy.

7. Service level

We work hard to keep the Service available, but we do not guarantee uninterrupted or error-free operation. To the fullest extent permitted by law we disclaim all implied warranties, including merchantability and fitness for a particular purpose.

8. Limitation of liability

Our aggregate liability arising out of or in connection with the Service is limited to the fees you have paid us in the 12 months preceding the claim. We are not liable for indirect or consequential loss, loss of profits, loss of goodwill, or loss of data. Nothing in these Terms excludes liability for fraud, death or personal injury caused by negligence, or any liability that cannot be excluded by law.

9. Indemnity

You will indemnify us against any claim arising from your misuse of the Service, content you submit, or your breach of these Terms.

10. Suspension and termination

We may suspend or terminate your access for material breach, non-payment, suspected fraud or security risk, or repeated policy violations. On termination, any rights granted under these Terms cease immediately.

11. Changes

We may update these Terms from time to time. Continued use of the Service after changes are posted constitutes acceptance of the updated Terms.

12. Governing law

These Terms are governed by the laws of England & Wales and the courts of England & Wales have exclusive jurisdiction over any dispute.
